Compare Listings

When handling the probate process, the initial step is to be granted the authority to list. There are numerous steps of importance that follow. It is important that the Broker is an expert in managing the demands of the Probate Real Estate Process. Sherman and Prestige Enterprise Realty provides such expertise:

  • Total awareness of California Probate Real Estate Documents
  • Knowledgeable in selling property with confirmation by court
  • Selling within 90% of the properties market value
  • Broker Price Opinion/BPO
  • Investigate chain of title to ensure it is clear of any encumbrances
  • Resolve any title issue as it relates the probate transaction
  • Arrange vendor repair services in advance to provide the property with the highest return

Receive Authority To List: Full vs Limited Authority

The first step in the management of the sale of a probate property is to be granted permission to list the property. In a probate case , there are two kinds of authority that may be delegated to Executors and Administrators. The Full Authority grants Executors and controls the authority to act with less oversight on behalf of the estate. However, Limited Authority includes further court supervision, including an added court hearing to allow any overbids.

Marketing Strategies

We design an aggressive marketing strategy, giving your property exposure to the local market and to the international communities to sell the property for the highest profit for your property. Advertising the property involves MLS exposure, designing and creating a custom website to advertise the property on multiple platforms including the creation of a YouTube video. Contact us of more information on marketing your probate property.

The Escrow process

After an offer for your property is accepted, we work to make the escrow process is seamless and without burdens by managing the process by communication and transparency. We confirm the buyers loan approval, verify buyers funds to purchase the property, and have all buyer's contingencies removed.

A court date is required to provide an opportunity for overbidders when limited authority is provided to Administrators and Executors. We work hard to advertise the property and its overbid to get the highest offer. We verify the buyers loan approval, buyer funds and confirm all buyers contingencies are removed.

When the Executors or Administrators are given limited authority the courts will schedule a court date to allow overbidders the opportunity to purchase the property. During this process the property is presented to the market with the overbid price to obtain the highest offer for your probate property.
